Tracy Morgan In Critical Condition After 6-Car Crash

Driver charged in incident; Morgan "more responsive"

A Georgia truck driver has been charged in the accident on the New Jersey Turpike that critically injured actor Tracy Morgan and killed another man early Saturday.

Middlesex County Prosecutors have charged Kevin Roper with 1 count of death by auto and 4 counts of assault by auto.  Police say Roper's tractor trailer rear-ended Morgan's limo bus, causing it to overturn.  Morgan was rushed to Robert Wood Johnson University Hospital and placed in intensive care; two other passengers from the limo bus are in critical condition, while a third is in fair condition.

63-year-old James McNair, a passenger in the limo who was Morgan's friend and comedy writer, was killed.

Police say Roper "failed to observe" slow-moving traffic until it was too late.  Roper tried to swerve out of the way, but slammed into Morgan's limo bus, setting off a chain reaction crash that involved a second tractor trailer, an SUV and two cars.

Brooke Buchanan, a Walmart spokesperson, said that truck driver is a Walmart employee.

Walmart CEO Bill Simon released a statement, saying:

"This is a tragedy and we are profoundly sorry that one of our trucks was involved. We are working quickly to understand what happened and are cooperating fully with law enforcement to aid their investigation."

Simon also stated that Walmart will take full responsibility.  "We offer them our deepest condolences. We can’t change what happened, but we will do what’s right for the family of the victim and the survivors in the days and weeks ahead.”

Morgan is still in critical condition. Morgan's rep, Lewis Kay, said in a statement on Sunday the actor will remain in the hospital for a few weeks.  "While Tracy remains in critical condition, he has been more responsive today, which is an incredibly encouraging sign," Kay said.

"He sustained a number of injuries including a broken leg, a broken femur, a broken nose and several broken ribs. He had surgery earlier today on his leg. We expect him to remain in the hospital for several weeks. His family is tremendously overwhelmed and appreciative of the outpouring of love and support from his fans."
