I took a fall and hurt my shoulder yet the store where I fell said they weren't responsible because I was in the parking lot. I don't have insurance and I'm in pain all of the time. After months of searching I found a lawyer who would take my case and he's sending me to Georgia to have surgery. He says he has a deal with an orthopedic practice there and could take the costs out of the settlement. Some of my friends and family think this sounds a little hinky but I'm in pain and don't know what else to do.

I'm with your friends. That does sound hinky. I've heard that stores aren't liable for falls in parking lots as a friend of mine fell and injured her ankle and needed surgery and legally the store was found not at fault. That being said, there's a really good chance you'll never see a settlement. Add to that driving a couple of hours away is bad enough when you're having surgery…but driving to another state? I understand what you're going through, as I had serious pain for two years before having rotator cuff surgery, but I think you need to do a lot of research on the attorney and the practice before agreeing to go through with it. Shoulders are tricky business!
